| 中文摘要:目的 通过描述分析新型冠状病毒肺炎疫情期间制售稀缺防疫物资违法案例的现状与特点，探讨此类违法行为防治的对策。方法 收集2020年1月1日至2020年2月29日国家市场监管部门发布的制售假冒伪劣口罩违法典型案件，对案件进行系统描述和定性定量统计分析。结果 制售假冒伪劣口罩违法典型案件共计334例，其中，制假19例，贩假315例。案源以举报投诉为主；案件特点为违法主体以自然人为主（116例）；微信等社交软件为重要销售渠道（83例）；违法行为类型多样（16种）。结论 在重大突发公共卫生事件期间，提出应对制售假冒伪劣防疫物资违法行为的防治对策，包括完善医疗器械相关法制建设、全链条打击违法行为、积极发挥互联网企业作用、加大违法案件公开力度。 |

| Typical case analysis of illegal production and sale of fake and shoddy masks during the Corona Virus Disease 2019 |

| Abstract:Objective By describing and analyzing the current situation and characteristics of illegal cases of manufacturing and selling scarce epidemic prevention materials during the outbreak of new coronavirus pneumonia, the countermeasures for the prevention of such illegal acts are discussed. Methods Collect the typical cases of manufacturing and selling counterfeit and inferior masks issued by the national market supervision department from January 1, 2020 to February 29, 2020, and systematically describe and qualitatively analyze the case. Results There were 334 typical cases of manufacturing and selling fake and shoddy masks, of which 19 were fakes and 315 were fakes. The main source of the case is to report complaints; the main characteristics of the case are natural persons (116 cases); social software such as WeChat is an important sales channel (83 cases); the types of illegal acts are diverse (16 types). Conclusion Explore the countermeasures for the prevention and control of illegal acts of manufacturing and selling counterfeit and inferior epidemic prevention materials during major public health emergencies, including improving the legal system construction of medical devices, cracking down on illegal acts throughout the chain, actively playing the role of Internet companies, and increasing the disclosure of illegal cases. |
